Terms of Service

Introduction

Following are terms of services for website development, integration and hosting provided by Rob Townsend Online Consulting ("RTOC"). An instruction from the client to proceed with the order for such services, transmitted by email or other electronic communications method, indicates agreement to these terms of service.

Services

The primary service provided by RTOC is the building of simple websites, including the integration of third party online services. Hosting of websites is provided by third parties selected and commissioned by RTOC.

The website provided by RTOC will, unless expressly agreed with the client, be maintained by RTOC for a minimum of 12 months, or until the site is removed from the Internet, whichever is sooner. Reasonable amendments (e.g. text and image changes) will be included in the agreed site setup cost. Significant new additions (e.g. new sections, redesigns, new content types) will be quoted for as new projects.

The client will not, unless expressly agreed with RTOC, have access to directly update the website. If such access is agreed, RTOC will transfer technical ownership of site (with the hosting provider) to the client. If required, instructions on how to perform updates to the site will be provided by RTOC to the client, at an agreed fee.

Additional services related to online marketing can be provided by RTOC in agreement with the client. These include as examples, but are not limited to: logo design; copywriting and editing; email newsletter design; online strategy advice.

Pricing

The agreed price quoted upfront for the development and launch of the website will include reasonable amendments as described above, and the hosting fees for the first 12 months.

Hosting beyond the first 12 months will be charged at a flat £20 per annum. This fee can be waived at the discretion of RTOC.

If any third party services or applications integrated into the site have their own subscription charges, these are not included in the RTOC price and are the direct responsibility of the client. For the avoidance of doubt, this includes domain name registration, which remains the responsibilty of the client throughout.

Payment

Payment of RTOC invoices is required within 14 days of invoice date.

Content

The client is responsible for all content posted or stored on their web hosting space. RTOC exercises no control over the content or information contained on the site. RTOC will not be responsible for any direct, indirect, or consequential damages which may result from the use of this service by its customers or any other related or unrelated third parties. RTOC is not responsible for backing up data or recovering data in case of loss on the customer’s behalf. There are no warranties expressed or implied for the services the RTOC provides.

Additionally, the site content must not violate the terms of service for the hosting companies used by RTOC (Wordpress; Carrd; Squarespace).

Service interruptions

RTOC is not responsible for interruptions of service beyond its control. This includes interruptions by its suppliers and natural disasters.

Copyright

The copyright of the client website is transferred to the website purchaser after full payment has been received for the website. If copyright transfer has been processed, customer may request a full backup of their website upon cancellation. This backup will include the entire file structure in a .zip file and can be provided to another website developer as required.

Cancellation

The client may cancel the website service at any time by requesting in writing its removal from the RTOC-provided hosting platform.
